Body psychotherapist, massage therapist, and alternative practitioner for psychotherapy (§ 1 HeilprG)

1. Scope of the Contract

These terms and conditions govern participation in the massage training course offered by Enrico Fonte, Bodymind Therapy. By registering for the course, participants agree to be bound by these terms.

2. Registration and Payment

Registration for trainings, educational programs, or courses takes place online through our website. Participation is only confirmed after receipt of the full payment or the agreed first installment.

After successful registration, participants will receive a confirmation email with all relevant information.

3. Cancellation Policy

3a. Statutory Right of Withdrawal (14 days)

Participants have a statutory right of withdrawal of 14 days in accordance with §§ 355 ff. BGB (German Civil Code), starting from the date the contract is concluded (online booking).

If the withdrawal is exercised within this period, the contract will be cancelled in full, and any payments already made will be refunded. After the statutory withdrawal period has expired, the following cancellation conditions apply.

3b. Cancellation conditions after the withdrawal period

If the organizer cancels the entire training for any reason, the full course fee will be refunded.

Cancellation – Early Bird or discounted price: No refund possible

Cancellation – Standard price

91 days or more before the course starts: Full refund minus 10% processing fee
31 to 90 days before the course starts: 50% refund minus 10% processing fee
30 days or fewer before the course starts: No refund

For training bundles, the cancellation policy applies to the entire package. Individual modules within a bundle cannot be cancelled or refunded separately. Cancellation must be made before the start of the first module.

Cancellations must be submitted in writing via email to info@bodymindtherapy.de. If the cancellation is received on a weekend, it will be considered received on the next working day.

In cases of severe medical conditions that genuinely prevent participation for the entire training, we may consider a refund on an individual basis. This requires an official, detailed medical certificate from a licensed physician, clearly stating the nature of the condition and its impact on your ability to take part in the training. The final decision will be at our discretion.

Participants who do not complete the training for personal or health reasons are not entitled to a refund. However, they may retake the full training within one year at half the course price stated on the website.

No transfers to future courses

Please note that transferring your booking to a later course is not possible. Your registration is valid only for the booked course date. If you are unable to attend, the above cancellation policy applies. Refunds or transfers to another date are excluded.

4. Admission Requirements

4a. Participation Requirements & Personal Responsibility

The training is an adult education program and is open to participants of full legal age. Participants bear full responsibility for their health and well-being throughout the training. The content provided in the course may only be applied within the scope of the participant’s education level and in accordance with relevant legal regulations.

Participants from outside Germany must clarify the legal framework for applying the knowledge in their respective countries.

Before starting the training, participants are advised to consult with a physician if they have any health concerns, as the organizer does not assume liability for health risks that may arise during participation.

4b. Ethical Code & Conduct Commitment (Only for Massage and Bodywork Trainings)

All participants agree to follow the Bodymind Therapy Ethical Code, which outlines the expected behavior during training, practice sessions, and internships. The code includes mandatory verbal consent, respectful communication, and non-discriminatory conduct.

Violations of this code – including during test sessions or external practice – may result in immediate termination of the training contract without refund and, where applicable, notification of relevant authorities.

The Ethical Code will be sent before the course begins and must be signed by the participant. By signing, participants confirm their commitment to uphold and follow these principles.

5. Finances

Participants are required to pay the course fee, which includes 0.00% VAT as per the VAT exemption under § 4 Nr. 21 UStG (educational services are exempt). Any discounts or voucher deductions will be detailed in the invoice.

The course fee does not include the cost of specialized literature, which participants may need to purchase separately. These costs will be clearly communicated before the course begins.

6. Study Duration

The duration of each training, educational program or course is specified on the corresponding website.

If the organizer must cancel any training sessions, they will be rescheduled for a later date. In the case of force majeure events (e.g., natural disasters, pandemics), the schedule may also be adjusted. Participants will be notified promptly in these cases.

7. Instructor Contact

Instructor Enrico Fonte will be available throughout the training to answer subject-related questions. Participants can reach him by email, but responses may take up to 48 hours, depending on his availability.

8. Completion and Certificate

8a. Bodymind Certificate

All trainings follow the content and methods of the Bodymind Therapy approach. The duration of each training, course, or program is specified on the corresponding website.

At the end of a training program, participants may take an internal final assessment consisting of both a theoretical and a practical part. The first assessment attempt is included in the course fee. Retakes or rescheduled assessment appointments are possible up to three times per module and cost €59 each.

Participants who successfully pass the final assessment receive a Bodymind Therapy certificate. Participation in the assessment is voluntary. Participants who choose not to take the assessment will receive a certificate of participation instead. The Bodymind Therapy certificate may only be used professionally or listed on a CV after successfully passing the final assessment.

For shorter courses without a final assessment, participants receive a certificate of participation upon completion.

If participants are unable to complete the training for personal reasons, they may repeat it once within one year at 50% of the standard price, subject to availability.

8b. Missed Sessions

To receive either a Certificate of Completion or a Certificate of Participation, any missed class sessions must be made up through private instruction. These sessions can be booked individually or in a small group and are only valid during the training period. In addition to covering missed content, these sessions can also be used to deepen your technique or revisit specific material.

9. Data Protection & Confidentiality

By registering, participants agree that their personal data will be stored and processed in accordance with the General Data Protection Regulation (GDPR) for the purpose of conducting the training and maintaining participant records. Participants may also receive information and offers via email, which they can opt out of at any time.

Participants are obligated to maintain confidentiality regarding any private or sensitive information shared during the training, in accordance with § 203 StGB (German Criminal Code). Any breach of confidentiality could result in legal consequences.

All materials provided during the training are protected by German copyright law (Urheberrecht) and may not be copied, distributed, or published without explicit written consent from the organizer.

10. Copyright

The study materials provided are intended solely for the registered participant. These materials may not be resold, digitized, or distributed to third parties without written consent from the organizer. All materials are subject to German copyright law.

11. Data Protection Information

We process your personal data to manage your registration, conduct the training, and issue certificates. In accordance with Article 6(1)(b), (c), and (f) of the GDPR, we may use your data to send you relevant information about future trainings or offers. Participants may object to the use of their data for marketing purposes at any time by contacting us at info@bodymindtherapy.de.
